Liability Waiver

(To be agreed by each driver and all passengers)

I, the Undersigned, hereby declare to have voluntarily decided to participate in the 40th anniversary of the Maserati Khamsin to be held from June 14th - 17th June 2012 near Dijon, France.

For participation purposes, I further declare that:

• I fully agree that by being part of this event and by participating in the Tour De Boulogne I accept that this event is not a race or a rally of any type, and that I will respect other participants and road users at all times.
• I fully agree to accept any and all possible risks of property damage, personal injuries and death resulting from the event;
• Neither I, or any of my assignees, heirs, distributees, guardians or legal representatives, will make any claim against, sue or attach any property to Eau Rouge Publishing, Marc Sonnery or The Maserati Khamsin Registry, or any of their heirs, corporations or affiliates, agents, attorneys or other participants in the Event, including other drivers, guests and their licensees (“Released Parties”), due to property damage, personal injury or death, whether or not due to negligence, acts of omission of any Released Party incident to the Event, excluding fraud, willful injury or violation of the law;
• I have the necessary skills, knowledge and experience to participate in the Event as either a driver or a passenger;
• The vehicle I will be driving or in which I will be passenger has been thoroughly inspected recently by a competent mechanic and is in good working order to compete safely in the Event;
• I release all Released Parties from any liability for property damage, personal injury or death that is caused in whole or in part by my failure to install or wear any safety equipment in my vehicle, or for the failure of such equipment to function in the manner it was intended to function;
• I will not violate any driving laws and rules as they apply to general driving in France or other locations where the Event occurs, regardless of the acts of other participants in the Event;
• I have third party/liability insurance coverage for my vehicle, a valid driving licence and that my vehicle is registered for use on public roads;
• I release the sponsors of the Event and their officers and directors from any loss, liability, damage, cost or expense that they may suffer by reason of breach of the Liability Waiver agreement.

I have carefully read and understand this agreement, being aware that it is as broad and inclusive as is permitted by the law in France or in any other State in which the Event may occur.

I declare that there are no oral representations, statements or undergoing that modify, increase, decrease or alter the scope of this agreement.
